FuzzyHosts Terms & Conditions

Our terms and conditions are to provide our clients with a general idea of what won't be tolerated on our servers. You must agree to the terms and conditions to use FuzzyHosts.com. If you do not we reserve the right to terminate your services with immediate effect. When you place an order with us it is with the understanding that you have read and agreed to everything here. FuzzyHosts reserves the right to modify these Terms & Conditions at any time.


1) Personal and Product Details

1.1) FuzzyHosts will not share any of your details with third parties, or use them for marketing purposes, except to law enforcement agencies in the United Kingdom, your country of residence or the country that FuzzyHosts servers are located in.

1.2) It is our clients' responsibility to keep all passwords safe and secure. FuzzyHosts is not responsible for any damages whether they be real, implied, direct or indirect that may have resulted from customer's giving out details.

1.3) We will not grant anyone access to anything within your account unless they are a named contact on your billing panel. This is why we require all clients to contact us via ticket for account and services changes.


2) Account Usage

2.1) Any account found to be using or attempting to use our service for illegal or abusive activity such as, but not limited to: Denial of Service attacks, storage and/or transmission of copyrighted materials including "warez", MP3s, AVIs, software, War Bots and scripts, flood scripts/bots, hacking tools (such as but not limited to) root kits, sniffers, scanners or exploit programs, http/ftp/socks proxies, mail bombs, graphical images and intellectual properties or transmission of malicious code such as viruses, worm and Trojans will be terminated with immediate effect and will not receive any refund.

2.2) All accounts must stay within there set quotas. Customers will be contacted regarding this and a script will automatically kill processes that exceed the max number of processes for any given account type or which exceeds allowed CPU/Memory usage limits. If you go over your allowed bandwidth, you will also be required to purchase more.

2.3) Our burstable ram is for use for short periods for the installation and/or upgrading of software and is for use for short periods only, normally no longer than 2 hours unless a member of staff has been notified.

2.3) Reselling services or space on our shell servers is strictly prohibited and will result in immediate termination of Customer's account without notice or refund unless you have a reseller account from us, or have gained permission from a member of our staff.

2.4) 'Free Domains' remain the property of FuzzyHosts should you leave us, we may however release them to you for a fee should you wish to purchase them from us.

2.5) When purchasing a shoutcast server from FuzzyHosts, we do not provide a license for you to run this or to broadcast music if one is needed.  You will be responsible for any legal issues which may arise due to licencing laws in your country.


3) Account Billing

3.1) FuzzyHosts does not have a refund policy and does not offer a money back guarantee of any type. We consider sales to be final. You may cancel your account with us at any time.

3.2) Failure to pay your account will lead to your account being suspended after 4 days and terminated after 7 for Dedicater Servers and 14 days for all other services unless a member of staff has been notifyed reguarding late payments.

3.3) Failure to pay your account on time will lead to a late payment fee of 15% of the due balance (minimum late fee of £1) being added 5 days after failure to pay account on time.

3.4) From time to time we may run sales and or promotional offers to try to bring in new business. With these sales and offers existing customers may not be eligible to take advantage of the new prices. At the same time if we raise our prices then that will not affect current clients. There prices will always stay the same for the whole time they are with us. Promotion will not continue if you upgrade your product.


4) Support

4.1) FuzzyHosts primary purpose is to supply our customers with the hardware, network and software to run the service as described within the relevant products page. Our support of this type will take priority over all other aspects of support. We have split the support levels we offer into different categories this is to ensure that we give you the best support for each of the services you have from us.

4.2) We offer a free transfer service from your current provider when you join with us. We take no responsibility in any loss of data during the transfer however every effort will be made to prevent this occurring.

4.3) Accounts that are not paid on time and are set as overdue may receive a slower support service, as we prioritise the up to date services first.

As a final note we will not tolerate abusive language or behaviour towards any staff, whether it is via regular mail, email, in the administrative IRC channel, by instant message or any other means. This may result in the customer's account being terminated for abuse without refund.

What Personal Information About Customers Does FuzzyHosts Gather?
The information we learn from customers helps us personalize and continually improve your hosting experience at FuzzyHosts.  We receive and store any information you enter on our Website or give us in any other way. You can choose not to provide certain information, but then you might not be able to take advantage of many of our features. We use the information that you provide for such purposes as responding to your requests, fulfilling orders, improving our features, and communication with you. We receive and store certain types of information whenever you interact with our website. For example, like many web sites, we sometimes use "cookies," and we obtain certain types of information when your Web browser accesses our website. To help us make e-mails more productive to improve service and your shopping experience, we sometimes send you newsletters of our services and products, notifications of changes to our policies, and order confirmations.

What About Cookies?
Cookies are alphanumeric identifier text files that we transfer to your computers hard drive through your Web browser to enable our systems to recognize your browser and to provide features such as storage of items in your Shopping Cart between visits.

How Does FuzzyHosts Share the Information It Receives?
We will use your personal identifiable information for payment purposes and to provide convenient and targeted support, to contact you and announce special offers, general announcements and news and to improve our service and the marketing of our service. This could include using your demographic location to improve targeting of our website and customise your visit.

We will NEVER provide your personally identifiable information to any persons other than A law enforcement or regulatory agency at their request, third parties who provide services on our behalf such as payment processing, only if they agree not to miss use this information.
Your personal information is safe with us. Our service is not available to anyone under the age of 13, never will we intentionally maintain information about anyone under the age of 13.

How Secure Is Information About Me?
We fully encrypt information sent in your client area via SSL. It is important for you to protect against unauthorized access to your password and to your computer. Be sure to sign off when finished using a shared computer by clicking the "log off" link located in the side menu.

Which Information Can I Access?
You can access all your personally identifiable information that we collect by logging into your password-protected FuzzyHosts account and selecting to update your 'My Details' We use this procedure to better safeguard your information. You can also correct factual errors in your personally identifiable information by sending us a request that shows error. To protect your privacy and security, we will also take reasonable steps to verify your identity before granting access or making corrections.

Conditions of Use, Notices, and Revisions
If you choose to visit FuzzyHosts, your visit and any dispute over privacy is subject to this Notice and our Terms Of Service, including limitations on damages, arbitration of disputes, and application of the law of our country. If you have any concern about privacy of your personal information as used and collected within our website, please send us a thorough description by clicking on the "Contact Us" link on the menu, and we will try to resolve it.
Our business changes constantly, and our Privacy Notice and the Conditions of Use will change also. We may e-mail periodic reminders of our notices and conditions, unless you have instructed us not to, but you should check our Web site frequently to see recent changes. Unless stated otherwise, our current Privacy Notice applies to all information that we have about you and your account. We stand behind the promises we make, however, and will never materially change our policies and practices to make them less protective of customer information collected in the past without the consent of affected customers.

Information You Give Us
When you sign up for any of our services we will ask you to provide contact information for your convenience as well as legal reasons. This will include name, home address, e-mail addresses and payment details (PayPal). If you need support our staff may need to know information to solve the problem such as operating system, browser software and editing software.

Automatic Information
For security purposes FuzzyHosts sometimes collects and analyzes the Internet protocol (IP) address used to connect your computer to the Internet, and to our website. This is done for your protection for tracking purposes in the unfortunate event that someone gains access to your personal or financial information and opens an account, or makes purchases under your name.

Service Level Agreement

To ensure that customers are provided a service level consistent with the high expectations of both FuzzyHosts and our customers, we have the following Service Level Agreement (SLA) covering service interruptions related to network, power, and hardware.

100% Uptime on Power and Network

FuzzyHosts will provide each VPS and dedicated server client 100% uninterrupted transit to the Internet and 100% uninterrupted electrical power to each dedicated server. In the event that FuzzyHosts fails to provide 100% uptime to do so, customers are eligible to receive an account credit proportionate to the amount of time that the affected service was inaccessible.

SLA credits will be awarded as follows:
• For the first one hour of cumulative downtime occurred during the course of a billing month, a credit equal to 5% percent of the monthly recurring fees will be awarded to the client for each directly affected service.
• Should service interruption exceed that one hour minute period for a particular service, a 3% credit will be awarded to the client for each one hour period of cumulative downtime thereafter for that service.

Credits are awarded on a per service basis, meaning each billing service is considered a unique SLA credit and awarded accordingly. The service interruption accrued by an individual server is considered independent of that accrued by another server and, as such, credited independent of any other interrupted services.

FuzzyHosts provides unmanaged services. As a result, we do not actively monitor downtime of individual devices, and as such, FuzzyHosts will not be held liable for unreported downtime in situations where the downtime is isolated to a single customer. In the event that the customer takes longer than one hour to report downtime, the customer forfeits the SLA credit for time prior to one hour before submitting the ticket.

Four Hour Hardware Replacement SLA

FuzzyHosts guarantees to replace failed hardware components in regularly stocked dedicated servers at no cost to the client within a four hours of diagnosis by the FuzzyHosts staff. In the event FuzzyHosts does not replace the failed hardware within four hours of the time we diagnose the problem to be the hardware, we will credit your account for five days of service, calculated based on the cost of the monthly recurring fees directly related to the interrupted service.

Receiving SLA credits

No account credit shall be issued until an SLA credit request is made by the client. All requests for credits must be made within five days of the incident and after the incident is completed or no further service interruption is expected due to the incident. All requests for credits must be made by submitting a billing ticket.

Additional Conditions

SLA credits shall not exceed 75% of the monthly recurring fees associated with the service credited.

Service interruption that is caused by equipment and/or events that are the effect of or under the control of the client.

No part of this agreement shall cover loss of power or network as a result of the client's utilization of remote power or network management tools that may be made available to them by FuzzyHosts.

No part of this agreement covers service interruption that is caused by one or more devices on our network being the target or source of a DoS, DDoS, or other form of malicious attack.

No part of this agreement covers outages or other service interruption that is caused by scheduled or emergency network and systems maintenance.

Billing related service interruptions are not eligible unless they are a result of human error by a representative of FuzzyHosts. Services experiencing billing related downtime as a result of the action or inaction of an automated system (such as a PayPal subscription) are ineligible for SLA credits.

Service interruptions that are caused by the misconfiguration or mismanagement of the customer (e.g. an incorrect network configuration on the device) are not eligible.
